Medlens AI — Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using Medlens AI ("the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

2. Description of Service

Medlens AI is a clinical productivity tool designed for healthcare professionals. The Service provides:

• Audio recording and transcription of patient encounters
• AI-generated clinical notes (SOAP, H&P, DAP, and other formats)
• Medical document analysis and summarization
• AI-powered clinical decision support and risk score calculations

Not a Medical Device: Medlens AI is not intended to diagnose, treat, cure, or prevent any disease. All AI-generated content is for informational purposes only and must be reviewed and validated by a licensed healthcare professional before clinical use.

3. Subscription Terms and Auto-Renewal

Subscription Plans: Medlens AI offers subscription-based access to premium features. Subscription plans and pricing are displayed in the App at the time of purchase.

Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your iTunes Account (for iOS) or Google Play Account (for Android) will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

Managing Subscriptions: You can manage or cancel your subscription at any time through your device's account settings:

• iOS: Settings → [Your Name] → Subscriptions
• Android: Google Play Store → Menu → Subscriptions

Refunds: All purchases are final. Refunds are processed according to Apple App Store or Google Play Store policies. We do not provide refunds for partial subscription periods.

Free Trial: If offered, free trial periods automatically convert to paid subscriptions unless cancelled before the trial ends.

4. User Responsibilities

You agree to:

• Provide accurate account information and maintain its confidentiality
• Obtain all necessary patient consents and authorizations before recording or uploading protected health information
• Comply with all applicable laws, including HIPAA, GDPR, and local healthcare regulations
• Review and validate all AI-generated content before clinical use
• Use the Service only for lawful purposes consistent with its intended use

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Attempt to reverse engineer, decompile, or extract source code from the App
• Interfere with or disrupt the Service or its infrastructure
• Share your account credentials with unauthorized parties
• Use automated systems to access the Service without prior written consent
• Misrepresent AI-generated content as original professional work

6. Intellectual Property

The Service, including all software, design, branding, and AI models, is owned by Medlens AI and protected by intellectual property laws. You retain ownership of content you upload. By using the Service, you grant Medlens AI a limited license to process your content solely to provide the Service and improve our AI models (using de-identified or aggregated data where feasible).

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. MEDLENS AI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.

AI-generated clinical notes, summaries, and recommendations are assistive tools only. Healthcare professionals remain solely responsible for all clinical decisions. Medlens AI is not liable for any clinical outcomes resulting from use of the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDLENS AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Medlens AI, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any reason with reasonable notice. Upon termination, your right to use the Service ends immediately. You may request deletion of your data as described in our Privacy Policy.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated via the App or email when feasible.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
